Terms of use

The Piraeus Bank Group Cultural Foundation, hereinafter referred to as "PIOP", manages the website www.piop.gr, hereinafter referred to as "the Website", and any information or element (e.g. photographs, texts, graphs) contained therein, hereinafter referred to as "the Material", in order to present information to the public regarding its activity.

The use of the Website and the Material is subject to these Terms of Use, hereinafter "the Terms of Use", as in force at any given time, which constitute the agreement between PIOP and any person visiting the Website regarding the use thereof, hereinafter "the User or Users".

Access to and use of the Website in any way (including simple browsing) implies the User's unconditional acceptance of the Terms of Use, as in force at any given time.

2. AMENDMENT OF THE TERMS OF USE

PIOP reserves the right to amend the Terms of Use and any other rules governing the use of the Website at its sole discretion, announcing each amendment with a relevant notice on the home page of the Website. The Terms of Use will indicate the last date on which they were updated.

Continued use of the Website by the User after such notice shall constitute acceptance of such changes.

The use of the Website is subject to the Terms of Use in force at the time of use. The User should periodically check the Terms of Use in order to be informed of their content and is solely responsible for this information.

3. MORE SPECIFIC TERMS

In the event that the use of any service of the Website is regulated by more specific terms of use, these terms shall be considered as one with these Terms of Use. However, in case of conflict, the more specific terms of use of each service shall prevail.

4. USE OF THE WEBSITE BY MINORS

By accepting the Terms of Use, the User declares that he/she is an adult over 18 years of age or, if under 18 years of age, that he/she has obtained the necessary consent from the person(s) having parental responsibility for him/her and that he/she will provide his/her details if requested to do so. The holders of parental responsibility for minors must protect them from accessing content directed at adults and are solely responsible for any such access and shall be liable in the event of failure to do so.

PIOP's policy is not to check in advance the material or information provided by each user. PIOP shall not be liable for any access via the Internet to information, goods and services that are contrary to the law, morality or are inappropriate or inappropriate for certain categories of persons and especially for minors.

If the user considers that the Material or part of the Material infringes in any way his/her rights or the rights of third parties, he/she may send an email to info@piop.gr specifying precisely the Material or part of the Material that he/she considers offensive and the reasons supporting his/her claim.

5. RESPONSIBILITY OF PIOP FOR THE CONTENT

The Website is used "as is", subject to amendments by PIOP, without the possibility of modifications or other interventions by the User.

PIOP makes every effort to make the use of the Website safe and to provide through it accurate, complete, valid, reliable and up-to-date information. In any case, however, the Users acknowledge and accept that, given the nature and evolution of the products and services of PIOP as well as the nature and technical needs of the Internet, the latter may not be able to exercise at all times full control over the entire content and security of its Website and services.

PIOP is neither bound, nor does it guarantee, nor does it assume any kind of responsibility regarding the legality or otherwise of the use of the Website by the Users and regarding the accuracy, completeness and timeliness of the content of the Website and its security. Therefore, Users agree that they must evaluate the content and are solely responsible for their actions based on their use of the Website, including any decision to rely on the accuracy, completeness and/or validity of its content.

The use of the Site is at the user's own risk. PIOP, its employees and managers, its agents or any third party involved in the creation, production or publication of the Website shall not be liable, to the extent that exclusion of liability is permitted by law, for any direct, indirect, moral, positive or other damage of any kind arising out of or in connection with the use of the website or the material, including, but not limited to, the inadvertent downloading of computer viruses from the website or from e-mails sent from/to the website.

6. LINKS TO OTHER WEBSITES

The Website may contain links to websites owned or operated by third parties outside PIOP. These links are provided for the User's convenience only. PIOP has no control over and is not responsible for the operation, content, privacy policies or security of these websites. For example, PIOP is not responsible if third party websites:

- violate the rights of a third party,
- are not secure or are inaccurate, incomplete or misleading,
- contain viruses or other programs of a destructive nature.

PIOP does not endorse the content or the products or services offered on these sites and is not affiliated with the operators of these sites. Where the Website refers through "links" or hyperlinks to other websites, the owners and/or administrators of these websites bear full responsibility (civil and criminal) for the security, legality and validity of the content of their websites, excluding any liability of PIOP, such as, but not limited to, liability for violation of intellectual and industrial property rights. If the User accesses these websites, he/she bears the sole risk for this connection and access, without any involvement of PIOP.

7. INTERNATIONAL ACCESS

The Website can be accessed from all over the world. The Website may refer to products or services that are not available in the country of each User. These references do not imply that PIOP intends to make these products available in these countries.

PIOP, subject to Greek law, controls, manages and is responsible for the operation of the Website. Subject to the provisions set forth in these terms and conditions regarding the responsibility of PIOP for the content, PIOP does not guarantee and shall not be liable in relation to whether the Website, the Material, the products and/or services referred to therein are legal in countries other than Greece. If the User accesses the Website from a location outside Greece, the User is solely responsible for compliance with local laws.

8. COPYRIGHT AND INDUSTRIAL PROPERTY − LICENSING

8.1 Copyright

The Website, including its software, as well as the Material contained therein, constitutes the intellectual and/or industrial property of PIOP and is protected by the relevant provisions of Greek, EU and international law for the protection of intellectual and industrial property. Furthermore, the composition of the content and the layout of the elements of the Website contained on the Website at any time is the exclusive property of PIOP and is protected by the relevant provisions of Greek, EU and international law. The User is not hereby granted any proprietary rights to the Website and the Materials, except for the rights of use expressly provided for in these Terms of Use.

PIOP hereby expressly reserves all intellectual property rights to any and all elements of the Website, as well as to the Material, such as, but not limited to, copyright, industrial property rights to trademarks of products or services, trade names, distinguishing marks, etc.

8.2 Licensing - restrictions on use

Provided that the User complies with the Terms of Use and with the Privacy & Personal Data Protection Policy, PIOP grants to the User, free of charge, a limited, non-exclusive, non-transferable and non-assignable license to access, load, display on the screen of his/her device the Website and the Material and generally use it for the purpose specified in these Terms of Use. In this regard, each User acknowledges and accepts that the Website and its Material are intended for personal and not for commercial use only. Each User is entitled to "download" and/or copy and/or store individual portions of the Website's Material for strictly personal use and not for commercial purposes, without deleting the indications of its origin and provided that he/she protects any and all proprietary rights of PIOP from any infringement.

For any other purpose, the above actions will be permitted only if they are carried out upon the written consent of PIOP. Access to the Website or any of the aforementioned actions will in no case result in the creation of any right, title or interest in any part or all of the Website that was "downloaded" and/or copied and/or stored.

Except for the permitted uses mentioned above, the Website and its Material may not be reproduced, copied, leased, sold, sublicensed, assigned, transferred, exported, transmitted, broadcast, or distributed in whole or in part in any way by any User, nor may it be borrowed or granted for use. Under no circumstances may the Website be used for commercial purposes. It is expressly prohibited to modify, adapt, adjust, translate or otherwise alter the Website and the Materials and to create derivative works or improvements. Likewise, decompiling (except to the extent permitted by law), or disassembling, reconstructing or otherwise attempting to obtain the source code of the Website is prohibited. It is also not permitted to create and/or publish a database containing significant parts of the Website without the prior express consent of PIOP.

On the basis of the above, the User pledges not to create derivative works based on the content of the Website, not to copy, reproduce, republish, "upload", modify, transmit, sell or exploit in any way, in whole or in part, the Website, its related software or its Material. Further, he/she pledges not to index the Website, not to frame it with another website, not to insert it as a link for direct access from another website to its internal information, not to copy its location to another server by creating an idol, and not to promise a third party a right to the Website without the express prior written consent of PIOP.

Also, actions to circumvent or violate the security or content usage rules provided, implemented or enforced by any functionality (including but not limited to the digital rights management) contained on the Website are prohibited. It is prohibited to use the Website to access, copy, transfer, encode or retransmit any content in violation of any law or the rights of PIOP or third parties, or to remove, conceal or misrepresent any copyright, trademark or other proprietary rights statements of PIOP or third parties that are pasted or contained in or accessed in connection with or through the Website.

The use of the Website in any unlawful manner, for any unlawful purpose or in violation of applicable laws or regulations of the Greek Intellectual Property Law and relevant provisions of European and international law is prohibited.

By using the Website, Users unconditionally accept, agree and consent to make lawful and appropriate use of the Website, particularly in accordance with the terms set forth herein.

Any use of the Website that constitutes a violation of the Terms of Use is strictly prohibited and will automatically result in the termination of the aforementioned license. The license granted to the User may be freely revoked by PIOP, without prior notice.

Respecting and protecting the intellectual property rights of third parties is a fundamental principle of the PIOP’s policy. If, however, the user believes that his/her intellectual property rights are being infringed through the Website, he/she may inform PIOP by sending an e-mail to info@piop.gr specifying the part of the Website that he/she considers to be infringing his/her rights, as well as the reasons that he/she considers to constitute an infringement.

9. PERSONAL DATA AND PRIVACY PROTECTION

10. OFFICIAL ACCESS

The User agrees not to create or provide ways in which participation on the Website can be carried out from other websites or in a manner not approved by PIOP.

The user pledges and agrees not to use electromechanical computer equipment or software or any other method not approved by PIOP, which will affect the Website.

11. AVAILABILITY AND SMOOTH FUNCTIONING

PIOP makes every reasonable effort for the maintenance and availability of the Website. The Users, however, acknowledge that the Internet is an unstable medium and that the availability of the Websites may be affected by the users' equipment, other communication networks, the services of the Internet connection provider, the large number of people trying to use the Website at the same time or other causes. For these reasons, the Users agree that PIOP shall not be liable for any interruption or malfunction of the Website or for the failure of the Website to function properly.

The Website and PIOP are in no way related to the provision of Internet connectivity services and the User remains solely responsible for the payment of all dues to the competent providers of the relevant services and for ensuring his/her access to the Internet.

The Users agree and accept that PIOP may modify and/or temporarily or permanently suspend the operation of all or part of the Website with and/or without notice to the Users. For this reason, PIOP shall not be liable for any kind of damage due to the interruption of the operation or the malfunction of the Website or the inability of Users to access it, the suspension of all or part of it, the delay, non-delivery, interruption or poor quality of its services or the loss of its content or the existence of any kind of errors. PIOP does not guarantee that the Website will be compatible with the computer, hardware and software of each User.

12. SOFTWARE AVAILABLE ON THIS SITE

The intellectual property rights or other rights on the software available for visiting the Website belong to PIOP or its providers/licensors. In order to access information on the Website the User may have to sign a license with third party software providers. The User's ability to access this information may depend on whether the User has signed such licenses. The use of such software is governed by the terms of any license agreement contained in the software. PIOP assumes no responsibility for the arrangement of such licenses. It is recommended not to install or use software if the User has not obtained the relevant license. If the User, however, performs such actions despite the lack of a license, he/she bears the risk.

13. MAINTENANCE

In any case, PIOP reserves the right at any time to temporarily or permanently suspend the operation of all or part of the Website for maintenance or upgrade purposes or for any reason whatsoever, without any further liability.

14. SECURITY

Although PIOP makes every effort to protect the Website from digital viruses and/or any other type of harmful or destructive files (or programs) designed to interfere with, destroy or limit the operation of any software or telecommunications equipment, PIOP cannot guarantee that the Website will never be affected by such elements. Therefore, the integrity and preservation of the software systems and equipment of each User is subject to his/her own diligence and PIOP shall not be liable in the event that the electronic equipment (software and hardware) of the Users is attacked by malicious files and other harmful files as set forth above.

15. USER RESPONSIBILITIES

Users accept and agree that they will make lawful use of the Website. Users indicatively and not exclusively undertake that by using the Website:

• They will not act in a way that prevents and/or makes impossible the proper and/or lawful use of the Website and other linked websites by other users.
• They will not act in a way that infringes the intellectual or industrial property rights of PIOP or third parties (for information on the protection of intellectual property please read Copyright Protection).
• They will not act in such a way as to mislead any third party as to the origin of the content of the Website and/or damage in any way the reputation of PIOP.
• They will not install, promote and/or transmit in any way through the Website digital viruses and/or any other kind of harmful or destructive files and/or programs designed to destroy or limit the operation of any software or telecommunication equipment or to prevent other users from using the Website.
• They will not install or promote in any way unsolicited or not expressly approved by PIOP advertising messages in any form, unsolicited emails (spam) and generally will not promote unsolicited information in any way.
• They will not "upload" or transmit in any way material and information that they are not entitled to disclose by law or private agreement (e.g. confidential information).
• They will not act in such a way as to infringe any rights or the privacy of third parties and in particular in such a way as to cause harm to a minor.
• They will not interfere with or compromise the security or otherwise cause damage to the Website, the Material hosted in it, the source code of the software that constitutes it, the server where it is hosted and/or networks connected to or accessible through the Website or other websites connected to it.
• They will not pursue any purpose that is prohibited by these Terms of Use.
• They will not engage in conduct that could constitute or encourage conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any law.
• They will not publish or transmit any material with threatening, untrue, misleading,offensive, harassing, defamatory, vulgar, immoral, scandalous, pornographic or blasphemous content. PIOP will fully cooperate with all law enforcement authorities and will fully comply with any court order requesting or ordering the disclosure of the identity of any person who publishes or transmits such information and material.
• They will not collect email addresses or other user information from the Website by electronic or other means and for the purpose of making unsolicited, commercial or other communications with them.
• They will not "upload," transmit, store or make available to the public in any way photographs of third parties without their consent.
• They will inform PIOP as soon as they become aware of any illegal or prohibited use of the Website by third parties.

It is expressly stated that the use of the Website for advertising or offers by the user is prohibited, unless there is an explicit agreement with PIOP.

The use of any element of the Material other than as provided for in these Terms of Use is strictly prohibited without the written permission of PIOP. In case of violation of the terms of use, PIOP shall make full use of the legal remedies available to it by law, including that of criminal prosecution.

16. VIOLATION OF TERMS OF USE

In any case of violation of the present Terms of Use, Users will be liable to compensation for any positive and/or consequential damage to PIOP. The failure of PIOP to exercise its rights under these Terms of Use does not imply a waiver of these rights.

PIOP expressly reserves the right to supervise the compliance with these rules at its sole discretion.

17. INDEMNITY

The User agrees to protect, defend and indemnify PIOP, its partners, employees and in general the staff of PIOP for any damage and expenses, without limitation, that it may suffer and which may arise from or be related, directly or indirectly, to the User's misuse of the Website or to a violation of the Terms of Use.

18. TERMINATION

PIOP reserves the right to terminate without prejudice and without any further liability the agreement concluded hereunder with any User immediately and without notice, if the User violates the Terms of Use or any part thereof or if it is unable to confirm information provided by the User in the context of the use of the Website.

19. FULL AGREEMENT - DIVISIBILITY

These Terms of Use together with any other rules to which they refer, or which are found on the Website, constitute the entire agreement between PIOP and each User regarding the use of the Website. If for any reason any of these Terms of Use is held by a court of competent jurisdiction to be invalid and unenforceable, the validity and enforceability of the remaining terms will not be affected or impaired.

20. USER'S RELATIONSHIP WITH PIOP

The User agrees that no representative-represented, agent-represented, cooperation or partnership relationship of any kind or employment relationship is created between the User and PIOP as a result of the use of the Website by the User.

21. MEANS OF EVIDENCE

The printed version of the Website and the Terms of Use and any correspondence in electronic form will be accepted as evidence before judicial or administrative authorities.

22. APPLICABLE LAW AND JURISDICTION

These Terms of Use and any amendment to them are governed by Greek law. For any dispute that may arise from this agreement and which cannot be resolved out of court, the competent courts of Athens shall have jurisdiction.

All rights and remedies under the Terms of Use are cumulative and do not exclude other rights and remedies provided by law or other agreement.
